The request form requires a copy of the requestor's California driver's license or state ID, along with a detailed explanation of intended use.

The form prohibits sharing or transferring data to any other party without a new application and express written approval of the Secretary of State, and prohibits leaving voter data unsecured and publicly available online or offline.

Note: This conflicts with the relevant statute, which allows the list to be displayed on the internet "for election, scholarly, journalistic, or political purposes" except as determined by the Secretary of State. Cal. Elec. Code § 2194(a)(3).

However, the state's records request form requires swearing an oath that the records will not be used for any purpose unrelated to the electoral process, and that the information will not be made available to the public, third parties, or published in any searchable format.

A voter's full name, district/precinct designation, and voter status are public. All other personal information on the voter registration affidavit is confidential except for election or government purposes. HRS § 11-97.

It is unlawful to use, print, publish, or distribute any voter registration information acquired from registration affidavits or any list prepared from them unless authorized for election purposes. HRS § 11-14(d).

VRF submitted Maui County's voter data request and payment on 3/28/2022 but received no response. Honolulu and Kauai Counties denied VRF's FOIAs, citing HRS § 11-14(d).

On 7/12/2024, MA denied VRF's records request, citing Mass. Ann. Laws ch. 51, § 47C, which states that names and addresses in the central registry are not public records.

Following the First Circuit's decision in PILF v. Bellows, VRF requested records from MA. The request was denied and VRF was directed to obtain records from each of the 351 individual registrars.

Ongoing litigation: Voter Reference Foundation v. Galvin, Case 1:24-cv-12592 (D. Ma.). Fully briefed; oral arguments held 7/23/2025.

Only Minnesota residents may make a voter data request. MN Code § 201.091.4–5; see also Cilek v. Office of the Minn. Sec'y of State, 941 N.W.2d 411 (Minn. 2020).

Publication is prohibited under MN Code § 201.091.4(e)(1), which bars placing any information from the public list on the internet in any list, database, or searchable format, regardless of purpose.

VRF previously published Minnesota records but has since unpublished them following enactment of the publication ban.

NH will not produce voter files to VRF because it is not a qualified entity. Access is limited to political committees as defined under NH Code § 664:2(III).

An organization that makes $2,500–$5,000 in expenditures, including independent expenditures, qualifies as a political committee. NH Code § 664:2(III)(c)(d).

The previous Attorney General sent VRF a cease-and-desist letter arguing that Voteref.com constitutes unrestricted internet access, and that publication is therefore illegal. VRF subsequently unpublished SD records.

The Department of Elections may provide lists of registered voters to nonprofit organizations that promote voter participation and registration. Va. Code Ann. § 24.2-405.A.

As of 12/1/2025, VRF has not been able to obtain a file from Virginia.

VRF had previously acquired and published voter files, but VA passed a law prohibiting online publication, and the records were taken down.
